After spending several weeks in the court room, did you expect the whole truth to be given to you as a juror? How can we in society expect a jury to make a correct decision if they are not given the whole truth? You were personally required to make such a decision based only on the information Judge Raymond Lee decided you should hear. That is where my justice ended.

During the trial you learned I was arrested January 5th, 2003. What you were not told is I was charged for allegedly abusing the children in Michigan and Wisconsin and that I went through two trials in Michigan previously. The first trial was declared a mistrial and the second trial I was acquitted of all charges (Exhibit “A”). You will notice in Exhibit “A” Allison also had made allegations against me at one time.

After the Michigan trial, the state of Wisconsin decided to pursue charges. After the two Michigan trials I was financially ruined and had to rely on a public defender in Wisconsin. That public defender did nothing for my case except try to negotiate a plea offer. Remember, during these 2 ½ years Phoenix Police knew nothing of the allegations involving Arizona. Finally, in 2005 I accepted an “Alford” plea, a plea where I was able to still proclaim my innocence. The terms of the plea alledge 1 count of sexual abuse regarding Jasmin. I was placed on probation for 17 months and was required to register as a sex offender. The terms of the offer I accepted stipulated Arizona would not be told of the allegations, and I could get on with my life.

After I accepted the plea offer, I contacted the Kaukauna Wisconsin Police Department in an attempt to have my confiscated property returned. That property included computers I owned and software I spent years developing for my business. After I called the police department trying to get my property back, Detective Nejedlo was upset I never went to prison. He personally took it upon himself to let Phoenix Police know of the 2 ½ year old Arizona allegations, violating the agreement of the Wisconsin plea offer. That is how the case was referred to Arizona.

In July of 2005 I was re-arrested at my apartment in Appleton, Wisconsin regarding the Arizona charges. What additional information Judge Raymond Lee ruled you would never hear is that I bonded out of the Wisconsin County Jail on the Arizona charges. Yes, that’s right. I had opportunity to flee if I wanted to. But Judge Raymond Lee would not allow me to tell you about this important detail. Instead you, as a juror, were lead to believe all the information regarding my “packed truck” and documentation on creating a new identity was somehow important to the Arizona case, when in reality that wasn’t the case.

After my re-arrest in July of 2005 and bonding out of county jail for the Arizona case, I owned a car and had a drivers license. Never once did I flee or attempt to flee. Instead, I traveled voluntarily to Arizona to face the allegations rather than flee as you were lead to believe.

As for the case in Wisconsin, it was vacated (Exhibit “B”) or reversed. But you were not allowed to be told that either. Want to know why it was reversed? Because Jasmin committed perjury. She was proven to be lying about HER OWN AGE while testifying under oath in Wisconsin. Isn’t it ironic, I was found guilty because the girls were “believable”?

Now my new fight begins. I am about to go to prison for life simply because “the truth, the whole truth, and nothing but the truth” was not allowed to be presented to you, a juror required to make a decision with only half the facts. Still think justice is fair?

So why did I represent myself? Judge Raymond Lee ruled I couldn’t tell you about that either. I couldn’t afford to retain an attorney here in Arizona. Due to the length and complexity of the case it would have cost $150,000.00 to $250,000.00 for adequate representation, money I no longer have. Representation by the public defender system is a story unto itself. Hopefully you never have to experience it personally.

So what else did Judge Raymond Lee rule must be hidden from you? How about the fact Jasmin and Amanda themselves would report their siblings engaging in sexual activity, Jasmin having “sex-chats” on the Internet, or Jasmin on probation for stealing drugs from my dad and taking them to public school.

The case presented to you was very one sided. Ms. Phipps-Yonas filed, and Judge Raymond Lee granted, a motion entitled “State’s Motion in Limine to Preclude Testimony Relating to Phoenix Police Department’s Failure to Conduct [a] Proper Investigation”. This motion prevented me from cross examining the Phoenix police about why they never even asked to interview me. Some of the jury thought I must be guilty because you never heard testimony I immediately denied the allegations to anyone. Judge Raymond Lee prevented that testimony by granting a state motion entitle “State’s Motion in Limine to Preclude Introduction of Defendant’s Exculpatory Statements”. Yes, Judge Raymond Lee precluded testimony from witnesses who would have told you I vehemently denied abusing the children when I was initially confronted. How much more do you need to learn before you realize you sent an innocent person to prison for life, based on an incomplete story?
